Terms of Service Use

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and Action Force Community Group. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

These Terms govern your access to, usage of all content, Product and Services available at https://actionforce.org.uk website (the “Service”) operated by Action Force Community Group (“us”, “we”, or “our”).

Your access to our services are subject to your acceptance, without modification, of all of the terms and conditions contained herein and all other operating rules and policies published and that may be published from time to time by us. These Terms and Conditions apply to all visitors, users and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.

You represent that you are over the age of 18. Action Force Community Group does not permit those under 18 to use the Service.

Please read the Agreement carefully before accessing or using our Services. By accessing or using any part of our Services, you agree to be bound by these Terms. If you do not agree to any part of the terms of the Agreement, then you may not access or use our Services.

Intellectual Property

The Agreement does not transfer from Us to you any of Ours or third party intellectual property, and all right, title, and interest in and to such property will remain (as between the parties) solely with Action Force Community Group and its licencors.

Third Party Services

In using the Services, you may use third-party services, products, software, embeds, or applications developed by a third party (“Third Party Services”).

If you use any Third Party Services, you understand that:

  • Any use of a Third Party Service is at your own risk, and we shall not be responsible or liable to anyone for Third Party websites or Services.
  • You acknowledge and agree that We shall not be responsible or liable for any damage or loss caused or alleged to be caused by or in connection with the use of any such content, goods or services available on or through any such web sites or services.

Accounts

Where use of any part of our Services requires an account, you agree to provide us with complete and accurate information when you register for an account.

You will be solely responsible and liable for any activity that occurs under your account. You are responsible for keeping your account information up-to-date and for keeping your password secure.

You are responsible for maintaining the security of your account that you use to access the Service. You shall not share or misuse your access credentials. You must notify us immediately of any unauthorised uses of your account or upon becoming aware of any other breach of security.

Subscription services

We provide free and paid subscriptions for food help to our members. Some of our help is only available free for a limited period. Some is only available free to specific people, such as seniors, those who are very vulnerable, those who are disabled and those who are ill.

From 1st of September, we will provide all registered members with a food parcel once a month.

We charge £1 monthly membership fee to all  users who register with us on or after 1 July.

If members prefer or need a weekly food parcel, we will charge for it as stated in our subscriptions options unless you are elderly or disabled and, in some circumstances, such as if you have no access to public funds.

We only provide cooked food twice a week to those who are registered with us in certain circumstances such as the elderly, disabled, sick or those with no access to cooking facilities.

We provide our extra cooked food if any to people who are not elderly, disabled, sick or without cooking facilities for a small fee to cover our running costs but we need to know if you want this in advance at the start of each week.

 

How do I register ?

Our members will be able to subscribe to access food help via our website www.actionforce.org.uk.

Service providers and third parties will also be able to register and make payments on behalf of a third party  on free or paid plans via our website www.actionforce.org.uk.

For all service users currently registered with us, we will encourage those with online access to reregister before 20th September 2020 and we will help those who cannot do so.

 

What do I need to register

You need your bank card which should be valid and current and in your name.

You will need to give your address and telephone details.

You also need an email address.

If you use a smartphone, you will most likely need an email address to access the app stores or register your device

We will only email you about your subscription and with service updates

All information you give us is not shared with third parties outside our organisation except to get help to you

How do I pay?

We offer recurring payment options via recurrent payments using your bank card and payments will be taken in advance monthly.

Every month, exactly four weeks after a first payment is made, another subscription payment will be collected.

You will be able to view your invoices, change or cancel your subscription and view your subscription details in your account area on our website.

 

What if my recurring payment is cancelled?

If a subscription payment fails or your card is cancelled, we will allow service users to make payments directly to our bank account

If you cannot pay due to hardship, we will assess needs and consider giving free voucher codes.

If you cannot pay or miss a payment because you used someone elses payment card and we are directed to refund the money paid, we will report the matter to law enforcement and we will ban you from our service.

 

What to do if you cannot pay for your weekly pack?

Service users who know they cannot make their payment, but will need help can ask us to defer their payment at our discretion.

We may decide to downgrade a service user to monthly packs instead which are free if there are repeated payment problems

 

What if I get monthly help free but have an emergency?

You can ask for emergency help once in any 3 months in addition to their monthly pack which is free.

 

Refunds

We will refund any fees paid in advance if a service user cancels their service giving 2 weeks notice using the subscription cancellation option in their account.

Examples

Scenario 1: you pay your monthly subscription in week 1 and receive your free pack in week 1 and in week 2 you receive your paid pack but decide you want to cancel. We will refund you 1 week’s worth of subscription and deliver your last pack to you the week after you cancel.

Scenario 2: you pay your monthly subscription in week 1 and you want to skip one week’s delivery because you are away. We will refund you for the week you are away if you give us 2 weeks notice.

 

Scenario 3: You pay for your monthly subscription but you want to skip one week every month for three months. We will give you a month free or we will refund you for the three weeks you skipped, if you give us 2 weeks notice before you start skipping

 

Scenario 4: You pay your monthly subscription but had to go away as an emergency and could not give us 2  weeks notice. You have not been able to reach us in time, but it is an emergency. We will pause your subscription and your deliveries and restart them when you return home. But you must tell us or we will assume you wish to donate your subscription to help the elders who we help free of charge.

 

Restrictions on service use

Our services are not a shopping service or food source replacement for able bodied citizens.

We understand that people often struggle to make ends meet and our service is meant to help in emergencies and to supplement regular shopping so that you can put more meals on the table than you could with regular shopping.

You can not sell the items that you are receiving from us on. Although we charge a small membership fee, we operate as a community larder, we are not a wholesale club.

If we discover you are selling items, we will end your membership and cancel your subscription.

It is very difficult for us to specify or to meet specific demands and as you will understand, we focus on meeting specific demands for our seniors and those who are disabled. We are sure you agree that our seniors deserve to enjoy their golden years and should get the best we can get first before us young ones.

We will always try to deliver a good variety of items to you depending of course on what is available.

You can return items you cannot use and we will try to swap them for you if possible., otherwise, you can give items away to help others.

 

If you are a food bank, why are you charging me ?

We are a small organisation and we have provided free and unrestricted food help for many months before migrating to a sustainable model as a community larder and soup kitchen.

Our mission is to prevent food waste, prevent food poverty and prevent ill health by providing access to food. This is in line with our sustainable development goals available on our website here: https://actionforce.org.uk/sustainable-development-goals/

We have taken this approach because we want to keep on helping people even after the 2020 pandemic

We are aware that the pandemic impacted many people financially and our goal We acquire surplus food and donated food items which sometimes come with a small cost.

We also pay some running costs which are essential to make sure we keep on providing you with help.

Your subscription helps us to get good food to you at a reasonable cost and prevents food waste while helping our community eat well

Our Service do not contain links to third-party web sites or services that are not owned or controlled by Action Force Community Group except for the purpose of processing subscription payments and to provide our website in a state fit for your use.

Action Force Community Group has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Action Force Community Group shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use the Service will cease immediately.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of Action Force Community Group and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or £10 if You haven’t purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall Action Force Community Group or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if Action Force Community Group or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Some regions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party’s liability will be limited to the greatest extent permitted by law.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, Action Force Community Group, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, Action Force Community Group provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, neither Action Force Community Group nor any of Action Force Community Group’s provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of Action Force Community Group are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

Governing Law

The laws of England, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

Termination

We may terminate or suspend your access to all or any part of our Services at any time, with or without cause, with or without notice, effective immediately.

If you wish to terminate the Agreement or your Action Force Community Group account, you may simply discontinue using our Services.

All provisions of the Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting Action Force Community Group.

For European Union (EU) Users

If You are a European Union consumer, you will benefit from any mandatory provisions of the law of England in which you are resident in.

United States Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a “terrorist supporting” country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Terms shall not effect a party’s ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

Changes to These Terms and Conditions

Action Force Community Group reserves the right, at our sole discretion, to modify or replace these Terms at any time.

If we make changes that are material, we will let you know by posting on our website, or by sending you an email or other communication before the changes take effect. The notice will designate a reasonable period of time after which the new terms will take effect.

If you disagree with our changes, then you should stop using our Services within the designated notice period, or once the changes become effective.

Your continued use of our Services will be subject to the new terms.
